How We Disclose Personal Information

We may disclose personal information to the following categories of recipients when reasonably necessary for the purposes described above:

  • Shopify and commerce service providers that host and operate our online store and support checkout, payments, customer accounts, analytics, security, and related services.

  • Government authorities, regulators, courts, law enforcement, and other parties when required or permitted by law or when necessary to protect rights, safety, and security.

  • Parties to a business transaction, such as an actual or proposed merger, financing, acquisition, reorganization, bankruptcy, or sale of all or part of our business or assets.

  • Other parties at your direction or with your consent.

We do not disclose personal information merely for a recipient's independent purposes unless described in this Privacy Policy, disclosed to you at the time of collection, directed by you, or otherwise permitted by law.

Shopify

Our store is hosted by Shopify. Shopify processes personal information when you visit or make a purchase from our store and may provide services that use information from your interactions with our store, other merchants, and Shopify. We share personal information with Shopify and other service providers, which may be located in countries other than your own, to operate our store and provide services to you.

Where Shopify Network Intelligence or related enhanced services are enabled, Shopify may securely use information from your interactions with our store, other merchants, and Shopify to improve and personalize services, support fraud prevention, provide analytics, and deliver or measure advertising, subject to applicable consent and opt-out choices.

To learn more about how Shopify processes personal information and the rights available directly through Shopify, review the Shopify Consumer Privacy Policy and visit the Shopify Privacy Portal.

Cookies and Similar Technologies

We, Shopify, and our partners may use cookies, pixels, web beacons, software development kits, local storage, and similar technologies to:

  • Operate essential Site and checkout functions.

  • Remember your choices and preferences.

  • Understand Site usage and performance.

  • Prevent fraud and maintain security.

  • Personalize content, products, marketing, and advertising.

  • Measure the effectiveness of our campaigns.

Where required by law, we will ask for your consent before using non-essential cookies or similar technologies. You can manage available choices through our cookie banner or privacy settings. You may also configure your browser to remove or reject cookies, but doing so may affect the availability or functionality of parts of the Site.

Targeted Advertising, Sale, and Sharing

We do not knowingly sell personal information in exchange for money. However, some privacy laws may define certain disclosures through advertising, analytics, cookies, pixels, or similar technologies as a "sale," "sharing," or processing for "targeted advertising."

Depending on where you live, you may have the right to opt out of these activities. You may exercise available choices through the Your Privacy Choices or Do Not Sell or Share My Personal Information link displayed in our Site footer, through our cookie banner, or by emailing us at felixchristian@noveryxapparel.com.

Where required by applicable law and supported by our systems, we recognize browser-based opt-out preference signals, including Global Privacy Control (GPC), for the browser and device used to send the signal. Because these signals are device- and browser-specific, you may need to apply your preference on each browser and device you use.

Legal Bases for Processing

If you are located in the European Economic Area (EEA), United Kingdom, Switzerland, or another jurisdiction that requires a legal basis, we generally process personal information under one or more of the following bases:

  • Performance of a contract, including processing and fulfilling your order and providing requested services.

  • Legitimate interests, including operating and improving our business, communicating with you, preventing fraud, securing our services, and marketing our products where those interests are not overridden by your rights.

  • Consent, including for certain marketing, cookies, and personalized advertising. You may withdraw consent at any time, without affecting processing that occurred before withdrawal.

  • Compliance with legal obligations, including tax, accounting, consumer-protection, and regulatory requirements.

Data Retention

We retain personal information only for as long as reasonably necessary for the purposes described in this Privacy Policy, including to provide services, maintain business and transaction records, comply with legal and regulatory obligations, resolve disputes, prevent fraud, and enforce agreements.

Retention periods vary depending on the type and sensitivity of the information, the purpose for which it was collected, whether it is needed to provide services, the risk of harm from unauthorized use or disclosure, and applicable legal requirements. When information is no longer required, we may delete, de-identify, or anonymize it, subject to permitted backups and legal retention requirements.

International Data Transfers

Your personal information may be processed, stored, or transferred outside the state, province, or country where you live, including in the United States, Canada, and other countries where Shopify or our service providers operate. Those countries may have data-protection laws different from those in your jurisdiction.

Where required, we and our service providers use recognized safeguards for international transfers, such as contractual protections, approved transfer mechanisms, or adequacy decisions.

Your Privacy Rights

Depending on where you live and subject to applicable exceptions, you may have the right to:

  • Confirm whether we process your personal information and request access to it.

  • Request correction of inaccurate personal information.

  • Request deletion of personal information.

  • Obtain a copy of certain personal information in a portable format.

  • Opt out of the sale or sharing of personal information, targeted advertising, or certain profiling.

  • Restrict or object to certain processing.

  • Withdraw consent where processing is based on consent.

  • Limit certain uses or disclosures of sensitive personal information, where applicable.

We may need to verify your identity before completing a request. If you use an authorized agent, we may request proof that the agent is authorized to act for you and may need to verify your identity directly, as permitted by law. We will not discriminate against you for exercising applicable privacy rights.

If we deny a request and applicable law provides a right to appeal, you may appeal by replying to our decision or emailing us with the subject line Privacy Appeal. We will respond within the period required by applicable law.

Children's Privacy

Our Site and services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided us with personal information, please contact us so we can take appropriate steps to delete it.

Individuals under the age of majority in their jurisdiction should use the Site only with the involvement and permission of a parent or legal guardian. We do not knowingly sell or share the personal information of children or teenagers where prohibited by law.

Security

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information. However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security. Please do not send sensitive or confidential information through unsecured channels.

Third-Party Websites and Services

The Site may contain links to websites, apps, or services operated by third parties. We are not responsible for the privacy, security, or content of those third parties. We encourage you to review their privacy policies before providing personal information.

Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, services, technology, legal requirements, or other operational reasons. The revised policy will be posted on the Site with an updated "Last updated" date. Where required by law, we will provide additional notice of material changes.
